## Cookie Policy

What are cookies, which ones do we use at Waitry, what are they for, and how can you disable the ones you don’t want? Let’s cut to the chase.

## What are cookies?

Cookies are small text files that websites store on your device (computer, tablet or mobile phone) when you visit them. They allow the site to remember your actions and preferences – such as your language, whether you’re logged in, and what’s in your basket – for a certain period of time, so that you don’t have to reconfigure them every time you return or navigate from one page to another.

In addition to cookies themselves, Waitry uses equivalent local storage technologies (*localStorage*, *sessionStorage*). When we refer to ‘cookies’ in this policy, we are also referring to these technologies. Our mobile apps use device identifiers and local storage mechanisms specific to each operating system.

## Legal basis, in Europe and Latin America

Waitry operates in Spain and in several Latin American countries. The use of cookies on our platform is governed, depending on your location, by the following rules:

### Europe and Spain

- **Directive 2002/58/EC** (ePrivacy Directive), transposed into Spanish law by Article 22(2) of the **Act 34/2002** on Information Society Services (LSSI-CE).
- **Regulation (EU) 2016/679** (GDPR), with regard to consent for the processing of personal data via cookies.
- **Organic Law 3/2018** on the Protection of Personal Data and the Safeguarding of Digital Rights (LOPDGDD).
- The **Guide to the use of cookies** from the Spanish Data Protection Agency (AEPD).

### Latin America

- **Argentina:** Law 25,326 on the Protection of Personal Data, under the supervision of the Agency for Access to Public Information (AAIP).
- **Mexico:** The Federal Law on the Protection of Personal Data Held by Private Parties and its Regulations, which require that the use of cookies be disclosed in the privacy notice.
- **Colombia:** Act 1581 of 2012 and Decree 1377 of 2013, under the supervision of the Superintendency of Industry and Commerce (SIC).
- **Chile:** Law 19.628 on the protection of privacy, and Law 21.719, which strengthens the consent framework and establishes a data protection agency.
- **Peru:** Law 29733 on the Protection of Personal Data and its implementing regulations.
- **Uruguay:** Law 18.331, under the supervision of the Personal Data Regulatory and Control Unit (URCDP).

We apply the highest standard of all to everyone who visits us, wherever they live. It’s easier to understand and offers you greater protection.

Strictly necessary cookies are set without prior consent, as they are essential for the platform to function (Article 22.2 of the LSSI-CE, technical exemption). For the other categories – functional, analytical and marketing – we request your informed consent before setting them. You can change your preferences at any time.

## Categories of cookies

### Strictly necessary

They are essential for the basic functioning of the platform. Without them, the website and the app cannot function properly. They include cookies for session management, authentication, payment processing and fraud prevention. They do not require consent.

### Functional

They allow us to remember your preferences and settings to improve your experience: your chosen language, the branch you’re ordering from, or the contents of your basket. This also applies to the support chat (Crisp). They do not track your activity on other websites.

### Analytics

They enable us to understand how users navigate the platform, which pages are visited most frequently and how they interact with the various elements. This information helps us to improve the platform’s performance and usability. We use Google Analytics, via Google Tag Manager, to measure traffic.

### Marketing

They are used to display relevant content and measure the performance of our campaigns. We use HubSpot for visitor identification, campaign attribution and sales tracking, and Google Ads and Meta tags to measure the conversion rate of our adverts. If we introduce other marketing tools in the future, we will update this policy and ask for your consent before installing them.

## Cookies we use

### First-party cookies

### Third-party cookies

The exact details of cookies may vary depending on the integrations active at any given time and on the payment processor used by each business. If you notice anything missing, please write to us at [dpo@waitry.net](mailto:dpo@waitry.net) and we corrected it.

## Cookies in the mobile app

The Waitry mobile apps (iOS and Android) do not use cookies in the strict sense, but they do use equivalent local storage technologies – Keychain on iOS, Keystore on Android and local app storage – to:

- Stay logged in.
- Save your language preferences and settings.
- Manage push notifications.
- Analysing the use of the app.

Consent to the use of these technologies is requested the first time the app is opened, in accordance with the guidelines of the Apple App Store and Google Play.

## How to manage your cookies

### From the cookies notice

When you visit Waitry for the first time, we display a notice allowing you to accept or reject each category of cookies, except for those that are strictly necessary, which cannot be disabled as the platform will not work without them. You can change your choice at any time via the cookie settings link in the footer.

### From your browser

You can also configure your browser to block or delete cookies. Each browser does this in its own way, and they all explain how in their help sections: Google Chrome, Mozilla Firefox, Apple Safari and Microsoft Edge all have this option within their privacy settings.

### Disable specific tools

- **Google Analytics:** You can install the [additional disqualification order](https://tools.google.com/dlpage/gaoptout) offered by Google.
- **Google Ads and Meta:** by opting out of marketing cookies via our cookie notice, or via the ad settings in your Google or Meta account.
- **Crisp:** If you opt out of functional cookies in our cookie notice, the support chat will no longer be displayed.
- **HubSpot:** by opting out of marketing cookies in our cookie notice.

## What happens if you disable them?

- **Strictly necessary cookies disabled:** You won’t be able to log in, place orders or make payments. The platform stops working.
- **Disabled functions:** We won’t remember your language or your current order between sessions. You’ll need to set this up each time.
- **Analytics disabled:** It doesn’t affect your experience. It simply prevents us from understanding how the platform is used, which limits our ability to improve it.
- **Marketing options disabled:** It won’t affect your experience. We won’t be able to measure which campaigns are working.

## International transfers

Some of our suppliers (Google, Meta, HubSpot, Crisp and Stripe) process data outside the European Economic Area. These transfers are carried out in accordance with the safeguards set out in the GDPR:

- The **EU-US Data Privacy Framework** for certified suppliers.
- **Standard contractual clauses**, in accordance with European Commission Decision (EU) 2021/914.
- **Decisions on compliance** from the European Commission, where appropriate.

For further information on international transfers and suppliers, please see our [Privacy Policy](/es/privacidad).

## Updates to this policy

We may update this Cookie Policy to reflect changes to the cookies we use, regulatory changes or improvements to the platform. Any changes will be published on this page with the last updated date revised. If the change affects new categories of cookies or involves a substantially different processing of your data, we will ask for your consent again.
